The draft Investment Attraction Law: Towards neoliberal reform of the State in Ecuador

Abstract
At the beginning of February 2022, Ecuadorian President Guillermo Lasso submitted to the National Assembly the draft "Organic Law for the Attraction of Investments, Strengthening of the Stock Market and Digital Transformation", with the character of economic-urgent. Thus, it is intended to carry out the most important institutional transformation of the country since 1993, when the Law of Modernization of the State was approved and, once again, under a neoliberal conception of the State and society. In order to understand the scope and depth of these reforms, we analyze: (1) the legal change of public institutionality and its transformation into a delegating entity and its relationship with the private manager; (2) the transfer of public assets towards financial speculation mechanisms known as "shadow banking"; and, (3) the disarticulation of fiscal policy. It is concluded by pointing out that these reforms seek to create conditions for the minimal State of neoliberalism with preeminence of financial and banking capital, in a paradoxical context because they are reforms that alter the Constitution and that do not have sufficient support from the political system, but create a file of important political transitions.
