The legalization of euthanasia in Ecuador, challenges from a comparative perspective

Abstract

The research addresses essential issues in the search for the decriminalization of euthanasia, which is expected to serve as a research source for its implementation in the legal framework in Ecuador and not simply as a jurisprudential precedent. The Constitution has the necessary elements to recognize a dignified death as a right because it is a Constitutional State of Rights and Justice, for this, the methodology used in this research is the method of external comparative law because it allows comparing foreign legal systems with the aim of highlighting the similarities of each of them and verify that the legalization of euthanasia is not a legal problem but helps to keep us in line with the protection of human rights, Therefore, for its analysis we have considered comparing the legal systems of Spain, Colombia, Holland, Belgium and the State of Oregon, since they have been pioneers in the struggle for the recognition of a dignified death despite having different legal cultures. In summary, all this provides us with a valuable vision to explore this complex issue in order to propose a solution that contributes to guarantee individual rights from the decision making process in Ecuador.
