Crisis sistémica del capitalismo y el conflicto capital- vida: una ofensiva al derecho a la tierra

The maintenance of the heteropatriarchal and racist power structure, recovered and perfected by capitalism, leads to an intensification of the systemic crisis of this model characterized by the insurmountable conflict between the accumulation by dispossession of capital and the sustainability of life. A permanent crisis that in territories such as Latin America began with colonization and is currently sustained by the representatives of transnational capital, responsible for the perpetuation of a latifundist agrarian structure that concentrates land ownership. In the face of this historical scenario contrary to human, peoples' and nature's rights, it is observed that the lack of access to land presents its most nefarious dimension in rural areas, where the advance of necropolitics is as visual as it is necessary for the maintenance of this model of social organization incapable of generating life for itself. Using interdisciplinary analysis and seeking to apprehend reality as a whole, this study proposes a dialogue between the critical theory of law, legal sociology, the agrarian question and feminism to understand the territorial bases of the model of domination and to reveal the actuality of land control for its maintenance.
