The Human Right to water in Ecuador: Analysis of Ruling Num. 232-15-JP/21

Access to potable water is a fundamental right recognized internationally and is vital for human existence. In Ecuador, this right has been confirmed and recognized through various legal regulations. This article aims to analyze the human right to water through a review and jurisprudential analysis, which will allow for the examination of the principles and legal foundations that support this right within the national legal framework, identifying its main implications for both citizens and the State. Additionally, the social and environmental consequences of this decision will be explored, considering the importance of sustainable management of water resources and its effect on the quality of life of citizens. This study is based on a qualitative approach, as it involves a thorough examination of the social, legal, and political dimensions associated with access, management, and protection of water. The review of various bibliographic sources and the evaluation of judicial rulings, including the resolutions of the Constitutional Court, will help determine whether, after 15 years of constitutional recognition, the Ecuadorian State has effectively guaranteed the right to access water, taking into account the challenges that still persist in its implementation.
