Abstract

This article moves the issue of Brazilian democracy and the possible strategies for the decryption of the concept of people within a constitution. Insert it in the field of constitutional theory, notably geared towards critical constitutional theory, it uses anti-colonial studies to help understand portion of the current phenomena. The central objective is to expose some of the causes for the concealment of the people in Brazilian constitutional practice, that is, the opacity of the law and constitutional encryption. For that, the research adopts the deductive and descriptive method with national and foreign bibliographic research, in the theoretical aspect, to identify the meanings and the scope of the concealment process follows the bases of the democracy theory raised to the umpteenth power. As result, confirm the hypothesis of that the combination of these two variables, in addition to other factors, can generate the “hidden people” and compromising the possible ideas of democracy. In the end, in conclusion, the radicalization of democratic practices requires before the reversal of the causes pointed in the field of study.
