The procedural system and its incidence on the victims of Gender Violence in Portoviejo during the year 2021

Abstract

This article is focused on analyzing the procedural system and its impact on victims of Gender Violence. Based on the review of the cases dealt with in the Portoviejo Public Defender's Office during the period January - September 2021. The Public Defender of the city of Portoviejo, reports the following cases of Gender Violence in the aforementioned period; physical violence (101 cases); psychological violence (17 cases); sexual violence (18 cases), femicide (4 cases) and attempted femicide (7 cases). This study was based on the doctrine of the criminal legal-procedural framework on victims, the rights contemplated in the COIP Comprehensive Organic Criminal Code and regarding access to justice. A study framed in the paradigmatic modality with a qualitative approach was carried out because it involves collecting and analyzing data, through interviews with 10 specialists in the area of ​​Law, where the bibliographic review method was used to provide the reader with an overview of Violence. of Gender and the influence in the procedural system on the victims of these infractions. After the analysis of the results, it is obtained that violence against women crosses several social spheres, among which dynamics of discrimination and the exercise of power between genders stand out, denote that the victims of Gender Violence suffer certain obstacles to access and scope. of justice such as the unenforceability of comprehensive reparation, followed by the still existence of gender stereotypes, the dehumanization of the victim and impunity.
